1. Service Provider & Applicable Law
1.1. The Service is operated by eComTech (MAHI AHMED ECOMTECH), a sole proprietorship registered in Morocco: RC N°6312, IF N°25009853, ICE N°002031524000024. Registered address: N° 46 Lot Fatima Azzahraa, 2éme étage, Kasba Tadla, Maroc. Contact: contact@startdpp.com | Phone: +212 663-745054.
1.2. These Terms are governed by Moroccan law. Any disputes shall first be submitted to amicable resolution (mediation) before the competent courts of Casablanca, Morocco. This does not affect the statutory rights of consumers under EU Regulation 1215/2012 (Brussels I bis) if you are a consumer domiciled in the EU.
2. Definitions
In these Terms:
- “Service” means the Digital Product Passport platform operated by us;
- “DPP” means a Digital Product Passport as defined by the EU ESPR Regulation (EU) 2024/1781;
- “User” means the person or legal entity subscribing to the Service;
- “Content” means all product data, documents, images, and metadata uploaded by the User;
- “Paddle” means Paddle.com Inc. or its affiliates, acting as Merchant of Record.
3. Acceptance & Agreement
3.1. By creating an account, making a payment, or using the Service, you expressly accept these Terms in their entirety. If you are accepting on behalf of a legal entity, you represent that you have the authority to bind that entity.
3.2. If you do not agree with any part of these Terms, you must not access or use the Service.
3.3. These Terms constitute a binding contract between you and eComTech. They supersede any prior agreements or understandings, whether written or oral.
4. Service Description & Limitations
4.1. StartDPP provides a software-as-a-service platform for preparing, generating, publishing, and archiving Digital Product Passports. The Service includes a dashboard, QR code generation (GS1 Digital Link compliant), data export (JSON-LD, PDF, CSV), and optional IPFS/Arweave archiving.
4.2. No Guarantee of Compliance: The Service is a tool, not a compliance service. StartDPP is not a certification body, not a notified organism under EU Regulation 765/2008, not an accredited verifier, and not affiliated with the European Commission. DPPs generated using the Service do not constitute proof of regulatory compliance. Users remain solely responsible for ensuring their DPPs meet all applicable legal requirements.
4.3. No Legal Advice: We do not provide legal, regulatory, or compliance advice. Information published on our website, blog, or within the Service is for general informational purposes only. You should consult a qualified legal professional for advice on ESPR compliance and applicable regulations.
4.4. Service Availability: We aim for 99.5% uptime but do not guarantee uninterrupted availability. The Service may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control. No SLA (Service Level Agreement) is provided unless explicitly agreed in a separate written contract.
5. Account Registration & Security
5.1. You must create an account with accurate and complete information. Each account is personal and may not be shared with third parties without our prior written consent.
5.2. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access.
5.3. We reserve the right to suspend or terminate accounts that violate these Terms, that are used for unlawful purposes, or that pose a security risk to the Service or other users.
6. Subscriptions, Payments & Tax
6.1. Paid plans are billed monthly or annually. All payments are processed byPaddle.com Inc., our Merchant of Record. Paddle handles all payment processing, tax collection (including EU VAT where applicable), invoicing, and compliance. By subscribing, you agree to Paddle's terms of service and privacy policy.
6.2. Prices are in Euros (€) exclusive of applicable taxes. VAT is added at checkout where required by EU VAT rules, determined by Paddle based on your location.
6.3.Subscription fees are non-refundable except as expressly provided in our Refund Policy. We may change prices with 30 days' notice. Continued use after the price change constitutes acceptance.
6.4. Upon cancellation, you retain access to paid features until the end of the current billing period. No partial refunds are provided for early cancellation unless otherwise stated in the Refund Policy.
7. User Content & Intellectual Property
7.1. You retain all rights, title, and interest in the Content you upload to the Service. You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, and display your Content solely as necessary to provide the Service to you.
7.2. You represent and warrant that: (a) you own or have obtained all necessary rights and permissions for your Content; (b) your Content does not infringe any third-party rights; and (c) your Content complies with all applicable laws and regulations.
7.3. The Service, including its software, design, trademarks, logo, and underlying technology, is owned by MAHI AHMED ECOMTECH (trading as eComTech) and protected by intellectual property laws. No license is granted except the limited right to use the Service as expressly provided in these Terms.
8. Data Processing & Privacy
8.1. Our collection and processing of personal data is governed by our Privacy Policy (see below).
8.2. To the extent that you provide us with personal data of third parties (e.g., your customers, employees, or suppliers), you represent that you have the legal basis to share such data with us and have provided all necessary notices and obtained all necessary consents.
8.3. Both parties agree to comply with applicable data protection laws. A Data Processing Agreement (DPA) is available upon request and is incorporated into these Terms by reference.
9. Data Portability & Archiving
9.1. You may export your Content at any time via the dashboard in JSON-LD, PDF, CSV, and ZIP formats. There is no vendor lock-in. The Service is designed for easy data portability.
9.2. If you choose the IPFS/Arweave archiving feature, you acknowledge that: (a) archived data is immutable and cannot be edited or deleted; (b) the storage is provided by third-party decentralized networks; (c) we remove personal identifiers before archiving; and (d) once archived, data persists independently of your subscription status.
10. Acceptable Use & Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws (including EU/ESPR regulations);
- Upload Content that is false, misleading, fraudulent, or infringes third-party rights;
- Attempt to circumvent access restrictions, pricing tiers, or platform security measures;
- Reverse engineer, decompile, or attempt to extract the source code of the Service;
- Use automated scripts, bots, or scrapers without our written permission;
- Transmit malware, viruses, or any code of a destructive nature;
- Interfere with or disrupt the integrity or performance of the Service.
11. Limitation of Liability
11.1. To the maximum extent permitted by applicable law, the Service is provided“as is” and “as available”, without any warranty, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
11.2. We expressly disclaim all liability for: (a) the accuracy, completeness, or legal sufficiency of any DPP created using the Service; (b) any regulatory penalties, fines, or enforcement actions arising from your use of the Service; (c) any indirect, incidental, special, consequential, or punitive damages; and (d) any loss of profits, data, goodwill, or business opportunity.
11.3. Our total aggregate liability for any claim arising from or related to these Terms or the Service shall not exceed the total amount paid by you in the 12 months preceding the event giving rise to the claim.
11.4. This limitation of liability does not apply in cases of fraud, gross negligence, willful misconduct, death or personal injury, or any liability that cannot be excluded or limited under applicable law.
12. Indemnification
You agree to indemnify, defend, and hold harmless MAHI AHMED ECOMTECH (trading as eComTech), its officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your Content; (c) your violation of these Terms; or (d) your violation of applicable law, including but not limited to GDPR, EU ESPR, or other regulatory requirements.
13. Termination
13.1. You may terminate your account at any time from the dashboard or by contacting us.
13.2. We may terminate or suspend your account immediately for breach of these Terms, non-payment, or conduct that we reasonably believe could harm the Service or other users.
13.3. Upon termination: (a) your paid subscription rights end at the close of the current billing period; (b) we will retain your Content for 30 days to allow you to export it; (c) after 30 days, your Content and personal data will be deleted from our active systems; (d) any data archived on IPFS/Arweave will persist as immutable records in accordance with the nature of those networks.
14. Force Majeure
Neither party shall be liable for delays or failures in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, riots, embargos, acts of civil or military authorities, fire, floods, accidents, strikes, shortages of transportation, fuels, energy, labor, or materials, failure of telecommunications or internet infrastructure, or pandemics.
15. Modifications
15.1. We may update or modify these Terms at any time. Material changes will be communicated via email (to the address associated with your account) and/or by a prominent notice on the Service.
15.2. If you do not agree to the modified Terms, you must discontinue use of the Service before the effective date of the changes. Continued use after the effective date constitutes acceptance.
16. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the original intent.
17. Entire Agreement
These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and eComTech regarding the Service, superseding all prior agreements and understandings.

We will respond to complaints within 7 business days. If your complaint is not resolved to your satisfaction, you may submit it to the competent court in Casablanca, Morocco, or to the relevant consumer protection authority in your country of residence.
